The Ontario Government recently passed “Bill 13 Supporting People and Workers Act” which makes some important changes to the Occupational Health and Safety Act (OHSA). This article by Norm Keith gives a great summary of the details on the changes.
The change that will have the biggest impact is that the workplace health & safety rep/JHSC rep now has permission to send their investigation documentation directly to a Ministry Inspector, which may then be used against the employer when determining fault.
As well, employers with fewer than 5 workers may now have to prepare a workplace health and safety plan, and review/update that plan annually.
